TERMS & CONDITIONS OF ENROLMENT

By submitting this enrolment form, you acknowledge and agree that your enrolment is and participation in any course or program is subject to these terms and conditions and any program rules that apply to the course.

Approval by Royal College of Healthcare (“the College”)
You acknowledge and agree that your Enrolment in any Course is subject to the final approval of the College and that such approval may be given or withheld at the sole discretion of the College. In the event that your Enrolment is rejected, you will be provided with a full refund of any Course Fees within 14 business days from the date of the rejection of your Enrolment, less an enrolment processing fee of $180.

Course Fees
Your Enrolment is subject to the full payment of any Course Fees. Subject to any exception outlined below, Course Fees cover all Course Materials. Course Fees are GST inclusive where GST is applicable.

Course Materials exclusions
Course Materials (and Course Fees) do not include personal stationery, special materials outside of the Course’s prescribed texts and any other study related material you may elect to purchase. You are entirely responsible for any costs and expenses related to accessing and/or running the Course Material on any computer system. The course fee does not cover postage to the College of your assessment items.

Non-transferable
Your Enrolment in a Course is personal to you and may not be transferred to any other person for any reason whatsoever.

Delivery of Course Materials
Course materials will be sent to you as you progress through your Course and submit your assessments. The College reserves the right to withhold provision of Course Materials in the event that you fail to pay any part of the Course Fee as and when it becomes payable.

If you are paying by instalments, you must pay all such instalments on or before the due date. In the event that the instalments are to be paid by way of direct debit, you must ensure that you maintain sufficient funds in your account to meet the instalment payments.

The College will not be responsible for the costs of any redirection of the Course Materials where you fail to provide the College with your correct delivery address, or fail to notify the College of any change to the Delivery Address after the Course Materials have been dispatched.

You will be responsible for the cost of replacing any lost or damaged Course Materials after they have been received by you, including the cost associated with delivering replacement Course Materials.

Assessments
The mode of assessment varies from Course to Course and includes submission of written assessments and workplace assessment. The College reserves the right to change the mode of assessment applicable to a Course at any time in it’s sole discretion, including after your Enrolment.

Workplace assessment is a mandatory component of all of our aged care courses. The College will confirm with you the suitability of your work placement arrangements and will liaise with appropriately qualified supervisors in relation to your workplace assessments.

Time limits
You are required to complete Diplomas within three years from the Enrolment Date. All other Courses must be completed within two years from the Enrolment Date. In the event that you do not complete the course within the given timeframe, your enrolment will be immediately cancelled without refund. If you wish to continue with your Course after the expiry date, an additional fee of $250 will be charged and a maximum extension of six (6) months will be granted. Extensions are subject to availability and the College retains the right to refuse an extension at its absolute discretion.

Refunds
Enrolment fees are no refundable, except where (a) your enrolment is not accepted by the College; or (b) where the College cancels a course.

The fee structure requires that tuition fees be paid up front or in accordance with the payment plan. Should a student cancel their enrolment once the course has commenced, the full tuition fees must still be paid.

Tuition fees are not refundable, except in the following circumstances:

• Workplace based delivery – If the College is notified four weeks in advance prior to the commencement date, all deposits paid will be refunded in full. Notification after this date but prior to course commencement will attract a 50% refund. Once the course has commenced, no monies will be refunded. Cancellation of an enrolment must be notified in writing to the College with the reason clearly detailed.

• College Cancellation of Course – In the unlikely event of the College cancelling a course (for reasons outside the control of the student), students will be entitled to a full refund or credit of funds to a future course
• Medical Conditions – Students who can provide a medical certificate for a serious illness will be refunded the remainder of monies unused or be offered opportunities to complete the remainder of the course within the next two (2) student intakes

Copyright and intellectual property
The Course Materials which the College provides to you shall become your property. However, all Course Materials are protected by copyright and are intended only for your individual learning purposes. You must not publish, copy, sell, broadcast or otherwise reproduce or distribute any of the Course Materials otherwise than as permitted by law. Course Materials provided to you may contain licence agreements. Your enrolment is subject to your compliance with any applicable licence agreements. You indemnify and release the College in respect of any action or claim that may arise as a result of your use of any Course Materials otherwise than in accordance with these terms and conditions.

No warranty or guarantee as to career advancement and improved remuneration
The College does not represent, warrant or guarantee (expressly or impliedly) that your Enrolment, or completion of any Course, will result in, or improve the likelihood of, you securing any kind of employment or other benefit. Where you are employed or engaged as an employee or consultant, the College does not represent, warrant or guarantee (expressly or impliedly) that your Enrolment, or completion of any Course will result in, or improve the likelihood of, you receiving an increase of remuneration or any other benefit.

You are solely responsible for ensuring that the purchase of, and your Enrolment in, any Course is appropriate to your specific needs and objectives.

 

No warranty or guarantee as to successful completion of Course
The College does not represent, warrant or guarantee (expressly or impliedly) that you will meet assessment criteria and successfully complete the Course. Whilst every effort is made by the College to ensure that the Course Materials are accurate and sufficiently detailed to allow you to attain the competency, skills and knowledge to meet assessment requirements and complete the Course, you are solely responsible for ensuring that you

undertake the steps required to meet and fulfil all Course requirements.

Errors in the Course Material
Whilst every effort is made by the College to ensure the accuracy of Course Materials, the College does not represent, warrant or guarantee that Course Materials will be error free, accurate and/or up to date at all times. For the avoidance of doubt, the College will not refund Course Fees on the basis that Course Materials were not error free, accurate and/or up to date.

Limitation of liability
The College does not exclude any rights or remedies available to you under the Trade Practices Act 1974 (Cth) or equivalent State legislation that cannot be excluded or restricted. To the maximum extent permitted by law, the College is not liable (whether in contract, negligence or otherwise) for any loss or damage arising from, or in connection with, your purchase of, or Enrolment in, a Course, or the use of any Course Materials. To the maximum extent permissible by law, the College’s liability for breach of any implied warranty or conditions that cannot be excluded is restricted, at the College’s option, to:

• the re-supply of the Course or Course Materials; or
• the cost of the re-supply of the Course or Course Materials; or
• any amount paid by you to the College in respect of the Course or Course Materials.

You agree that in no circumstances will the College be liable for any indirect, incidental, special and/or consequential losses or damages of whatever nature arising out of or in any way connected with, your purchase of, or your Enrolment in a Course, or the use of any Course Materials (including, but not limited to, losses or damages arising out of, or attributable to, an act or omission by the College).

Severability
If any part of these Terms and Conditions is held invalid, illegal or unenforceable, that part shall be severed and the remainder will continue to be valid and enforceable.

Governing law
These Terms and Conditions constitute an agreement between you and the College in respect of the Service. This Agreement is governed by the laws of Queensland, Australia and you irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland, Australia and their respective courts of appeal.

Reservation of rights
Any rights not expressly granted to you herein are reserved by the College.

Student Declaration
By clicking on the submit button, you declare the following:

  • I declare that all information provided by me to be true and correct.
  • I am aware that it is my responsibility to supply all supporting documentation for my enrolment and agree it is my responsibility to provide the College with any changes to my enrolment (e.g. name, address, phone number, employer, vocational placement service).
  • I declare that I have read, understood and agree to the conditions of enrolment and college policies as outlined above in the Terms & Conditions of Enrolment and on the website, including the Refund policy.
  • I accept that the enrolment fee is non-refundable except in the event that the College declines my enrolment or in the event that the College cancels a course in which I enrol.
  • I accept that the College reserves the right to vary fees, course structure and delivery modes without prior notice.

  • Hospital and Emergency Care staff in emergency situations.
